
Before the legislation was enacted, the main challenge for foreign lenders has always been about proper collateral throughout the cycle. For instance, when an international lender financed a commodity like soybeans, they only got the soybeans as collateral which is not enough security for such lenders.
According to an expert at 10CFDs, many foreign lenders have always wanted the land as collateral but the government restriction that has been in place in Brazil since 2010 forbade foreign investors against land ownership. This restriction also stopped international lenders from holding ownership-type liens over farmland including fiduciary claims.
